1. Introduction

Welcome to WIBCS Academy ("WIBCS Academy", "we", "our", or "us").

These Terms of Use ("Terms") govern your access to and use of the WIBCS Academy website, Learning Management System (LMS), mobile applications, online platforms, digital resources, training programmes, memberships, products and services.

By accessing or using any WIBCS Academy service, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

2. Eligibility

You may use WIBCS Academy services only if:

• You are at least 18 years of age, or have the consent of a parent or legal guardian where permitted by law.

• You provide accurate and complete registration information.

• You comply with all applicable laws and regulations.

WIBCS Academy reserves the right to refuse or terminate access where these conditions are not met.

4. Course Registration

Course registrations are subject to:

Submission of an application does not guarantee enrolment.

5. Payments

Fees for training programmes, memberships and services are payable in accordance with the applicable quotation, invoice or payment plan.

Unless otherwise agreed:

• Fees must be paid by the due date.

• Instalment plans must be honoured in full.

• Late payments may result in suspension of access.

• Outstanding accounts may delay certification or examination bookings.

All prices are subject to applicable taxes unless stated otherwise.

6. Refunds

Refunds are governed by the applicable Refund and Cancellation Policy.

Where a refund is approved, any applicable administration fees or non-refundable costs may be deducted.

Examination fees, registration fees and third-party charges already incurred may not be refundable.

7. Student Responsibilities

Students agree to:

• Participate professionally.

• Complete coursework honestly.

• Meet assessment deadlines.

• Respect instructors and fellow learners.

• Maintain academic integrity.

• Follow all Academy policies.

Students remain responsible for maintaining any professional registration requirements applicable to their profession.

8. Academic Integrity

Students must not:

• Plagiarise.

• Cheat during assessments.

• Copy assignments.

• Submit another person's work.

• Use unauthorised assistance during examinations.

• Falsify attendance records.

• Alter certificates or academic records.

WIBCS Academy may investigate suspected academic misconduct and apply appropriate sanctions.

9. Certificates

Certificates will only be issued where:

• All course requirements have been met.

• Assessments have been successfully completed.

• Outstanding fees have been paid.

• Attendance requirements have been satisfied where applicable.

WIBCS Academy reserves the right to withhold certification where these requirements are not fulfilled.

10. Membership Services

Membership benefits may include access to:

• Online learning resources

• Professional development content

• CPD activities

• Webinars

• Member discounts

• Career resources

• Community forums

• Special promotions

Membership benefits may change from time to time without affecting any statutory rights.

11. Intellectual Property

All content provided by WIBCS Academy remains the intellectual property of WIBCS Academy or its licensors.

This includes, but is not limited to:

• Training manuals

• Course notes

• Videos

• Presentations

• Graphics

• Logos

• Assessments

• Examination material

• Policies

• Procedures

• Templates

• Software

• Website content

• Learning resources

You may not:

• Copy

• Reproduce

• Publish

• Sell

• Distribute

• Share

• Modify

• Reverse engineer

• Upload to other platforms

without prior written permission from WIBCS Academy.

12. Acceptable Use

Users must not:

• Use the platform for unlawful purposes.

• Upload malicious software.

• Attempt to hack or compromise our systems.

• Interfere with other users.

• Transmit offensive, abusive or discriminatory content.

• Impersonate another individual.

• Misrepresent qualifications or certifications.

• Use automated tools to scrape or harvest content without permission.

13. Online Learning

Where courses are delivered online:

• Internet access is the responsibility of the student.

• Appropriate equipment must be used.

• Students are responsible for ensuring compatibility with minimum system requirements.

• Live sessions may be recorded for educational or quality assurance purposes.

14. Professional Conduct

Users are expected to behave respectfully in all interactions with:

• Staff

• Facilitators

• Assessors

• Moderators

• Students

• Guest speakers

• Business partners

Harassment, bullying, discrimination, threats or abusive behaviour will not be tolerated and may result in suspension or termination of access.

15. User Content

Where users upload assignments, comments or other content, they confirm that:

• They own the content or have permission to submit it.

• The content does not infringe any third-party rights.

• The content is lawful and accurate.

WIBCS Academy may remove content that breaches these Terms.

16. Third-Party Services

Certain services may be provided by third parties, including:

• Certification organisations

WIBCS Academy is not responsible for the independent policies or services of these third parties.

17. Availability of Services

While we strive to provide uninterrupted access, we do not guarantee that services will always be available.

18. Limitation of Liability

To the fullest extent permitted by law, WIBCS Academy shall not be liable for any indirect, incidental, consequential or special damages arising from the use of our services.

Our total liability, where legally established, shall not exceed the amount paid by the user for the specific service giving rise to the claim.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

You agree to indemnify and hold harmless WIBCS Academy, its directors, employees, contractors and representatives against any claims, losses, liabilities, damages or expenses arising from:

• Your unlawful or negligent conduct;

• Your misuse of our services; or

• Your infringement of any third-party rights.

20. Suspension and Termination

WIBCS Academy may suspend or terminate access where a user:

• Breaches these Terms.

• Engages in fraudulent activity.

• Fails to pay applicable fees.

• Compromises the security of our systems.

• Behaves in a manner that may harm the Academy or other users.

Termination does not affect any accrued rights or outstanding payment obligations.

21. Privacy

Your personal information is collected, processed and protected in accordance with the WIBCS Academy Privacy Policy and applicable privacy legislation, including the Protection of Personal Information Act, 2013 (POPIA).

22. Amendments

WIBCS Academy reserves the right to amend these Terms at any time.

Updated Terms will be published on our website and will become effective upon publication unless otherwise stated.

Continued use of our services after publication constitutes acceptance of the revised Terms.

23. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of South Africa.

By creating an account, enrolling in a course, purchasing a product or service, becoming a member, or accessing any WIBCS Academy platform, you acknowledge that you have read, understood and agree to be bound by these Terms of Use.
